Terms of Service

Effective Date: October 9, 2026 · Last Updated: October 9, 2026

Section 0. Purpose and Agreement

0-1 These Terms of Service ("Terms") constitute a legally binding agreement between any person who uses the SACKGRAM app ("User") and Sackgram Labs, Inc. ("the Company") governing the conditions, rights, and obligations relating to use of the service. Creating an account or using the app constitutes acceptance of these Terms. If you do not agree, you may not use the SACKGRAM app.

0-2 Details on how the Company collects, processes, and protects Users' personal information are set out separately in the Privacy Policy.

Section 1. Age Restriction (18 Years of Age or Older)

1-1 SACKGRAM is a service for adults aged 18 or older. Persons under 18 may not create an account or use the app, even with the consent of a parent or legal guardian.

1-2 The date of birth entered during registration must be accurate. Using another person's information, or circumventing the age verification process (for example, by reinstalling the app), constitutes a material breach of these Terms.

1-3 If the Company has reasonable grounds to believe that an account holder is under 18, the Company may take any of the following measures without prior notice. These measures need not be taken in sequence, and if the account holder is confirmed to be a minor, the account will be terminated immediately:

1-4 If you become aware of an account belonging to a minor, or believe your account has been incorrectly identified as belonging to a minor, please contact info@sackgram.com.

Section 2. Account Management and Security

2-1 Users set their own SACKGRAM ID and password when registering. The Company does not request or collect phone numbers, email addresses, or real names.

2-2 Passwords exist only on the User's device. The Company cannot view a User's password and cannot reset or recover it.

2-3 If a User has registered a passkey in advance, the account can be recovered on a device that uses the same passkey ecosystem (the same password manager and authentication system) through biometric authentication (fingerprint or face) or screen-lock verification. If no passkey has been registered, no one, including the User and the Company, can recover the account.

2-4 Whether existing conversations are restored when an account is recovered depends on whether the conversation recovery feature is enabled. Details are set out in Section 9 of the Privacy Policy.

2-5 Users are responsible for keeping their devices and passwords secure, and are legally responsible for all activity and conduct that occurs through their accounts.

Section 3. Prohibited Conduct by Users

3-1 Users shall not use SACKGRAM to:

Section 4. Voice Privacy

4-1 "Voice Privacy" is a feature that shifts the pitch of the User's voice in real time on the User's device, before the audio leaves the device, so that the other party to the call cannot recognize or capture the User's original voice. The amount of time available varies by subscription plan, and the specific conditions are shown in the app. (This feature is currently offered on Android first.)

4-2 Voice Privacy is limited to changing the tone of the User's own voice. It does not provide any function to imitate, replicate, or synthesize (clone) another person's voice.

4-3 When Voice Privacy is active, an indicator is shown on the other party's screen to show that the feature is in use.

4-4 Users shall not use Voice Privacy to impersonate others, commit fraud, improperly obtain money, information, or property, or circumvent legal restrictions such as blocking or restraining orders. If there are reasonable grounds to believe the feature has been used for such improper purposes, the Company may take action under Section 7.

Section 5. User Content and Ownership

5-1 Users retain all rights to the content (messages, photos, videos, files, and the like) they send or share through SACKGRAM. The Company claims no ownership of such content and does not use it for any purpose other than providing the transmission service.

5-2 The Company does not own or operate its own database servers. The infrastructure needed to operate the service is provided by Google's cloud services (Google Cloud and Firebase, together "Google Cloud").

5-3 Messages, photos, videos, files, and call audio on SACKGRAM are end-to-end encrypted, and no third party, including the Company and Google, can read their contents. However, the minimum metadata necessary to provide the service (such as sending times and group names) is not covered by end-to-end encryption; the specific items are listed in Section 1 of the Privacy Policy.

5-4 Users are solely responsible for the content they send and for ensuring that they have the right to send it.

Section 6. Everplace Rooms and Signboards

6-1 The owner of an Everplace room may create a "signboard"—a public profile page that may include a business name, description, contact details, photos, and announcements—and share it outside SACKGRAM by QR code or link.

6-2 A signboard is a public page. Any User signed in to SACKGRAM can view it, and photos posted on a signboard are not encrypted. Do not post on a signboard any information that should remain private.

6-3 Posting false information on a signboard, impersonating any other person, business, or organization, deceiving Users, or promoting illegal goods or services is strictly prohibited.

6-4 The owner of a signboard may let in or decline anyone who asks to join. When someone is let in, they are notified; when someone is declined, no notification is sent.

6-5 Users may report an inappropriate signboard within the app. The reporter's identity is not disclosed to the owner of the signboard.

6-6 If a credible report is received, or if the Company determines that a signboard violates these Terms, the Company may remove the signboard from search results, take down the signboard, or temporarily suspend or terminate the owner's account. When a signboard is taken down, the reason and how to appeal are shown in the owner's app.

Section 7. Company Actions and Appeals

7-1 Because of its end-to-end encryption design, the Company cannot read or monitor Users' conversations. The Company's oversight and actions are limited to account status and publicly posted signboard information.

7-2 If a legitimate report of a violation of these Terms is received, or if an account is found to have been used in a violation, the Company may take down the signboard or temporarily suspend or terminate the account.

7-3 A User who disagrees with an action taken by the Company may submit an appeal to info@sackgram.com. The Company will review the matter again and, if it finds that its decision was in error, will restore the User's status to the extent possible (for example, by lifting a suspension) and explain the relevant next steps.

Section 8. Plans, Free Trial, and Refunds

8-1 Newly created accounts receive a free trial of paid features. The free trial does not convert into an automatically billed app store subscription, and no charge is made automatically during or at the end of the trial. If the User does not purchase a paid subscription after the trial ends, the account automatically moves to the free plan.

8-2 Paid subscriptions are purchased through the Google Play Store (or the Apple App Store), and the terms and payment policies of the relevant store also apply. Subscription prices, billing cycles, and renewal terms are shown on screen before the purchase is confirmed.

8-3 Paid subscriptions renew automatically at each billing cycle until the User cancels, and are charged through the relevant store account. The Company does not directly collect or store Users' payment methods or credit card information.

8-4 Subscriptions must be cancelled in the account settings of the store where they were purchased. When a subscription is cancelled, the next automatic payment stops, and the User can continue to use the service for the remainder of the period already paid for. For Google Play subscriptions, deleting the account stops automatic renewal from the next billing date, and amounts already paid are not refunded. App Store subscriptions must be cancelled directly in the App Store's subscription management menu.

8-5 Refunds and payment disputes are, as a rule, governed by the refund policy of the app store through which the purchase was made, subject to the following additional terms:

8-6 When a paid subscription ends, the User's account and stored data are not deleted immediately and remain in place.

Section 9. Changes to and Interruption of the Service

9-1 The Company makes every effort to provide the SACKGRAM service reliably but does not guarantee that the service will be uninterrupted or error-free.

9-2 The Company may change, temporarily suspend, or discontinue some or all features of the service for improvement or operational reasons. If a key feature is significantly reduced or materially changed, the Company will, where possible, give advance notice through in-app notifications or similar means.

Section 10. Termination

10-1 Users may stop using the service and terminate their user agreement at any time. The user agreement ends immediately when the User selects Settings → Delete account in the app. (Simply removing the app from a device does not delete the account or terminate the agreement.)

10-2 If a User violates these Terms, or where required by applicable law, the Company may suspend or terminate the account after giving notice through the app where possible.

Section 11. Disclaimer of Warranties

11-1 To the fullest extent permitted by law, the SACKGRAM service is provided "AS IS" and "AS AVAILABLE." The Company makes no warranties of any kind, express or implied, regarding the service, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of such warranties, in which case this section may not apply to you.

Section 12. Limitation of Liability

12-1 To the maximum extent permitted by law, the Company shall not be liable for any indirect, special, incidental, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from the use of or inability to use SACKGRAM.

12-2 The Company's total liability arising from or relating to these Terms and the service shall not exceed the greater of (a) the total amount paid by the User to the Company during the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).

12-3 The Company is not responsible in any way for content that a User has saved, leaked, or spread through third-party devices, external programs, or platforms other than SACKGRAM.

12-4 This section does not exclude or limit any liability that cannot be excluded or limited under applicable law, and some of these limitations may not apply under the laws of your jurisdiction.

Section 13. Indemnification

13-1 If a User's violation of these Terms or unlawful use of the service causes any claim, damage, loss, or legal cost (including reasonable attorneys' fees) to a third party or to the Company, the User shall indemnify and hold the Company harmless and compensate for such damage, except to the extent caused by the Company's intentional misconduct or negligence.

Section 14. Governing Law and Jurisdiction

14-1 These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. All legal disputes arising out of or relating to these Terms are subject to the exclusive jurisdiction of the competent courts located in the State of Delaware. However, where the mandatory laws of the User's country of residence guarantee the right to bring proceedings and the legal protections available in that country, those rights are preserved.

Section 15. Changes to These Terms

15-1 The Company may amend these Terms when necessary. When these Terms are amended, the "Last Updated" date at the top will be revised, and changes that materially affect Users will be announced in advance, before they take effect, through in-app notices or similar means. Continued use of the service after the effective date of the amended Terms constitutes acceptance of the amended Terms.

Section 16. Governing Language

16-1 These Terms may be provided in multiple languages. In the event of any inconsistency or conflict in interpretation between language versions, the English version shall prevail.

Section 17. Company Information and Contact

17-1 Single point of contact under the EU Digital Services Act (Articles 11 and 12): authorities of the EU Member States, the European Commission and the European Board for Digital Services, as well as users of the service, can contact the Company directly and electronically at info@sackgram.com. Communications to this point of contact can be made in English, German or Korean.

17-2 The Company's legal representative in the EU under Article 13 of the Digital Services Act is Prighter DSA GmbH. Its address and how to contact it are set out in Section 13 of the Privacy Policy.
